Article 3 as authorized by the State Council, the national certification and accreditation administration is in charge of national certification and accreditation

Article 4 the state publishes the unified catalogue of products subject to compulsory product certification in the people's Republic of China (hereinafter referred to as the catalogue) for compulsory product certification, determines the uniformly applicable national standards, technical rules and implementation procedures, formulates and issues unified marks, and stipulates unified charging standards

Article 5 products listed in the catalogue can only be sold, imported and used in business activities after they have passed the certification by the certification authority designated by the state, obtained the certification certificate issued by the designated certification authority and affixed with certification marks

Chapter II Organization and management of compulsory product certification Article 6 the General Administration of quality supervision, inspection and quarantine shall formulate rules and regulations for national compulsory product certification in accordance with relevant national laws and regulations; Approve and issue the catalogue

Article 7 the national certification and Accreditation Administration shall be responsible for the management, organization and implementation of the national compulsory product certification system, and perform the following duties:

(1) supervise and manage the national certification and accreditation work, and coordinate major issues related to certification and accreditation work

(II) draft, adjust and jointly issue the catalogue with the General Administration of quality supervision, inspection and quarantine

(III) formulate and issue the implementation rules for product certification in the catalogue

(IV) determine the applicable certification mode for product certification in the catalogue

(V) formulate and issue certification marks

(6) to stipulate the format and format of the certification certificate

(7) designate certification bodies and testing and inspection bodies serving them to undertake the testing and inspection work in compulsory product certification and certification activities

(VIII) publish the directory of designated certification bodies, designated testing bodies and inspection bodies serving them and their work scope

(IX) publish the list of certified products and their enterprises

(XI) guide local quality inspection administrative departments to investigate and deal with illegal acts of compulsory product certification

Article 8 local quality inspection administrative departments are responsible for performing the following duties:

(I) supervise the products in the catalogue of the regions under their jurisdiction in accordance with their statutory duties

Chapter III Implementation of compulsory product certification system

Article 10 product certification in the catalogue applies to the following single certification mode or a combination of several certification modes, specifically including:

(I) design appraisal

(II) type test

(3) sampling for testing or inspection at the manufacturing site

(4) market sampling inspection or inspection

(V) audit of enterprise quality assurance system

(VI) follow up inspection after obtaining certification

Article 11 the product certification implementation rules in the catalogue include the following basic contents:

(I) applicable product scope

(II) national standards and technical rules corresponding to applicable products

(III) certification mode and corresponding product types and standards

(4) rules or regulations for division of application units

(V) sampling and sample submission requirements

(VI) confirmation requirements for key components (as required)

(VII) testing standards, testing rules and other relevant requirements

(VIII) specific requirements for Factory review (as required)

(IX) specific requirements for follow-up inspection

(x) specific requirements for applying certification marks to applicable products

(XI) other provisions

Article 12 the product certification procedures in the catalogue include all or part of the following links:

(I) certification application and acceptance

(II) type test

(III) Factory review

(IV) sampling inspection

(V) evaluation and approval of certification results

(VI) supervision after obtaining certification

Article 13 the producers, sellers and importers of the products in the catalogue may, as applicants, apply to the designated certification authority for the certification of the products in the catalogue

Article 14 An applicant applying for product certification in the catalogue shall comply with the following provisions:

(I) submit certification to the designated certification authority in accordance with the provisions of the implementation rules for product certification in the catalogue, although they have also developed various applications for small panel control systems, necessary technical documents and samples

(2) if the applicant is a seller or importer, it shall submit copies of relevant contracts concluded between the seller and the producer or between the importer and the producer to the designated certification authority at the same time

(3) where the applicant entrusts others to apply for product certification in the catalogue, it shall conclude a contract with the entrusted party for certification, testing, inspection and follow-up inspection, and the entrusted party shall submit the power of attorney, copies of the entrustment contract and copies of other relevant contracts to the designated certification authority at the same time

(IV) pay certification fees in accordance with national regulations

Article 15 the designated certification authority is responsible for accepting the applicant's certification application, arranging type test, factory review, sampling inspection and other activities according to the provisions of the certification implementation rules, making certification decisions, and issuing certification certificates to the certified products

in general, the designated certification authority shall make a certification decision and notify the applicant within 90 days after accepting the applicant's certification application

Article 16 the certification certificate is a document to prove that the products in the catalogue meet the certification requirements and are allowed to use the certification mark

certification certificate includes the following basic contents:

(I) applicant

(2) product name, model or series name

(3) the producer, production or processing plant (site) of the product

(IV) authentication mode

(V) standards and technical rules on which the certification is based

(VI) date of issue and period of validity

(VII) issuing authority

Article 17 the name of the certification mark is "China Compulsory Certification" (the English name is "China Compulsory Certification", the English abbreviation is "CCC", or "3C" mark), The certification mark is the certification mark that the products in the catalogue are allowed to leave the factory for sale, import and use

the holder of the certification certificate shall use the certification mark in accordance with the requirements of the certification mark management regulations

Article 18 the designated certification authority shall have more work to do. According to the provisions of the specific product certification implementation rules, it shall carry out follow-up inspection on the products and their manufacturers (sites) that have issued certification certificates

Article 19 the designated certification authority shall cancel the certification certificate under any of the following circumstances:

(I) the national standards, technical rules or certification implementation rules applicable to product certification in the catalogue are changed, and the holder of the certification certificate cannot meet the above change requirements

(2) the certificate has expired, and the holder of the certificate has not applied for extension

(3) the certified product is no longer produced

(4) the holder of the certificate applies for cancellation

Article 20 the designated certification authority shall order it to temporarily stop using the certification certificate under any of the following circumstances:

(1) the holder of the certification certificate fails to use the certification certificate and certification mark as required

(2) the holder of the certification certificate violates the product certification implementation rules in the catalogue and the requirements of the designated certification authority

(III) the supervision results prove that the product does not meet the requirements of the product certification implementation rules in the catalogue, but the certification certificate does not need to be revoked immediately

Article 21 the designated certification authority shall revoke the certification certificate under any of the following circumstances:

(1) the holder of the certification certificate fails to take corrective measures within the period of suspension of the use of the certification certificate

(2) the supervision results prove that the product has serious defects

(III) serious quality accidents caused by serious defects of certified products

Article 22 If the applicant and the holder of the certification certificate have any objection to the certification decision of the designated certification authority, they may lodge a complaint and appeal to the certification authority that made the certification decision. If they still have any objection to the handling result of the certification authority, they may appeal to the national certification and Accreditation Administration Commission

Chapter IV Supervision and administration of compulsory product certification Article 23 the designated certification bodies and the designated testing institutions and inspection institutions providing services for them shall comply with the following provisions:

(1) accept the supervision and administration of the state certification and Accreditation Administration Commission

(II) implement the product certification, testing and inspection in the catalogue within the designated scope in accordance with the national laws and regulations on product quality certification

(III) ensure the accuracy of the certification results and bear the corresponding legal responsibilities

(IV) regularly submit the product certification information in the catalogue to the national certification and Accreditation Administration

(V) keep the trade secrets and technical secrets of the certified products, and shall not illegally possess the scientific and technological achievements of others

(6) without permission, it is not allowed to transfer the right to accept certification, the right to decide on certification, the right to test and the right to inspect to other certification bodies

(7) not engage in consulting and product development within the scope of certification responsibilities

(VIII) it is not allowed to sign bilateral or multilateral agreements with other institutions or organizations to mutually recognize the certification, testing and inspection results of products in the catalogue

(IX) no compliance
